banking law

Krawczyk & Partners LP advises on banking law, drawing up legal opinions and necessary documentation for both specific transactions and day-to-day banking activity. We also advise on banks' relations with supervisory authorities, and on the legal aspects of the process of outsourcing banking services.

We draw up and issue opinions on legal solutions relating to specific bank products, from the bank's relevant internal regulations to the day-to-day solving of legal issues.

Lawyers at Krawczyk & Partners apply their many years of experience when planning, evaluating, updating, and streamlining systems which secure receivables. With regard to this issue we place particular stress on the consolidation of documentation and the optimisation of security instruments, for the purpose, for instance, of increasing the sale value of blocks of receivables and making dealings with potential debt recovery agencies more efficient.
We also examine forms of collateral that secure banks' receivables used in foreign transactions from the point of view of requirements imposed by supervisory authorities and assess their admissibility in Poland.

We are able to conduct due diligence reviews of debt portfolios earmarked for sale, and assess the practical usefulness, with regard to legal aspects of securitisation, of debt portfolios (for instance the level of documentation consolidation and quality of debts), and we also offer advice on setting documentation standards and the classification of litigation cases.

Lawyers in the Firm's litigation department represent Clients in court and before bailiffs, and deal with disputed debts arising in connection with specific banking products.

Lawyers in the Firm's real estate department also perform due diligence reviews, commissioned by banks, of property development projects and special purpose vehicles if an entity of that kind is applying for financing.
