We have experience in placing medicinal products on the market, both OTC and RX. In the course of our practice we advise on the advertising and promotion of medicinal products, dietary supplements, and cosmetics. We have worked on numerous advertisements and marketing campaigns organised and carried out for a large number of manufacturers and distributors of medicinal products, cosmetics, and dietary supplements.
Due to the extensive know-how we have built up in the field of marketing and advertising, we are also able to advise on restrictions on promotion and advertising of medicinal products, dietary supplements, and cosmetics.
We issue opinions regarding the creation of advertisements and the mechanics and means of informing the public of promotions and other marketing activities, including loyalty and incentive programmes, competitions, promotional lotteries, and free gifts and prizes. Using our knowledge of the applicable restrictions and current practice in this area, we recommend optimal solutions, in compliance with advertising and marketing rules provided for in pharmaceutical legislation, the Act on Safety of Food and Nutrition, and the Act on Cosmetics.
We draw up agreements with business partners and subcontractors which reflect the requirements laid down in industry legislation and market practice, vital regulations concerning marketing campaigns, and the wording of advertising materials specifying the rules for such campaigns.
Other Polish legislation which forms the basis of our advice, apart from that listed above - is the Act on Combating Unfair Competition, the Act on Combating Unfair Market Practices, copyright law and intellectual property law, and also EU legislation, having regard in particular for the possibilities afforded by EU law with respect to marketing and sales campaigns conducted by pharmaceutical firms.
We advise on the issue of liability for clinical trials and represent the entities concerned; we also advise on the question of parallel import and statutory restrictions in this area.
