With respect to this area of specialisation we offer a complete range of legal services to domestic and foreign businesses during the bidding process as well as during the performance of the ensuing contracts. We also advise contracting parties in all matters related to the proper observance of public procurement procedures.

We perform analyses, from the legal and formal point of view, of the wording of invitations to tender and of Specifications for Material Tender Conditions, in order to eliminate wording that will hinder our Client's participation in public tender proceedings, by employing the legal measures available to contractors. With regard to this issue for example we draw up motions for clarification of the wording of Specifications for Material Tender Conditions, as well as protests and appeals.

Lawyers at our Firm advise on all aspects related to the setting up of a consortium for the purpose of bidding in public procurement proceedings, and in particular draw up consortium contracts and other documentation concerning the participation of consortium members in public tender proceedings.

We prepare drafts of bids, opening bids, and motions for admission to restricted tender procedures, and also review draft documentation prepared by our Clients to check for compliance with Specifications for Material Tender Conditions and the law. We also perform analyses, from the legal and formal point of view, of bids made by competitors to check for formal and legal defects giving grounds for rejection of a bid or exclusion of a competitor from the proceedings.

We prepare and review drafts of protests, appeals, and complaints and represent Clients in proceedings commenced using legal remedies.

As part of the services we provide to contracting parties we draw up tender documentation, such as drafts of invitations to tender, the Specifications for Material Tender Conditions, public tender agreements, invitations to enter into negotiations, and instructions and regulations We also review tender documentation drawn up by Clients to minimise the risk of it being successfully challenged by contractors.

We analyse bids, opening bids and motions for admission to restricted tender procedures submitted by contractors.

We also provide legal assistance with the examination of protests filed by contractors and tender participants, as well as with legal and formal examination of submitted appeals and complaints. Lawyers at our Firm draw up complaints and represent Clients in regional courts which examine legal remedies.

We provide advice and consultations, and issue legal opinions concerning issues relating to public procurement proceedings, such as choice of the appropriate type of procedure.

Our know-how also covers provision of legal advice to companies in the education sector with regard to proceedings for tenders for supply of goods and services, as well as representation of the company in appeal proceedings before the Public Procurement Office arbitration panel, the Public Procurement Office National Chamber of Appeals, and the Warsaw Regional Court. The lawyers at the Firm are also experienced in drawing up and performing legal reviews of bids submitted in tender proceedings subject to the Telecommunications Act.

According to data for 2006/2007 the Firm represented Clients in tender proceedings of a total value of over PLN 260,000,000.
