Monika Śmigielska has been a legal advisor associated with Krawczyk & Partners since 2007.
 

Her expertise is in public procurement law, and she uses it to support organizations including the Business Centre Club. As a recognized specialist on the implementation of EU funds, she advises units implementing, intermediating, and managing aid programs, as well as entities applying for EU funding. She has a wealth of experience in the field of finance law, with a special emphasis on public finances and financial accounting, including accounting for derivative financial instruments. In addition, her broad legal interests extend to handling mergers and acquisitions.


Professional Experience

Monika Śmigielska has diverse experience in providing service over the public procurement process, including procurements co-financed by the European Union. She also advises contractors applying for government contracts. Over the course of her extensive practice, she has advised ordering parties on all issues related to proper procedure in granting government contracts, as well as drafted and reviewed procedure documentation. She also provides legal assistance at the research and bid evaluation stages. She has significant experience in providing services to sector ordering parties. In addition, she supports contractors both during the process of bidding for and realizing public procurements, as well as in any disputes that may arise. She has been successful numerous times in representing clients in appeal proceedings in court and at the National Chamber of Appeals. Monika Śmigielska also advises the public and private sectors in matters related to public-private partnerships, including concessions for construction and services.
 

As a recognized specialist on the subject of EU funds, Monika Śmigielska counsels entities implementing, intermediating, and managing operational programs, as well as entities applying for EU funding. She represents applicants in appeals proceedings when their applications are evaluated negatively. She has authored numerous expert opinions on matters regarding the implementation of EU structural funds in Poland over the 2007-2013 program period.
 

Monika Śmigielska has a wealth of experience in the field of finance law, with a special emphasis on public finances and financial accounting. She advises on matters involving the management of public funds and breaches of public finance discipline. She provides legal services in disputes related to the improper use or receipt of subsidies.
 

Having a wide range of professional interests, Monika Śmigielska also advises on mergers and acquisitions, with a special emphasis on corporate and civil law matters, as well as M&A accounting.
 

She gives numerous lectures and holds many training sessions on public procurement.

2011 - Provided legal service to a rail transport sector ordering party regarding preparation for and holding a tender for public procurements
2011 - Provided legal services to a cultural institution over the course of its implementation of infrastructure investment under the 2007-2013 Masovian Voivodeship Regional Operational Programme totaling over 23 million PLN, including advising on the award of government contracts
2011 - Advised a telecommunications company on its application for co-financing for a broadband Internet backbone and access service network construction project amounting to over 150 million PLN, including representation in pre-court and court appeal proceedings
2011 - Wrote an expert opinion commissioned by the Ministry of Regional Development on the permissibility of using offsets and allowances under the Innovative Economy Programme over the years 2007 through 2013
2010 - Provided legal services for a construction company over the course of its bid for and realization of a public procurement for the construction, conversion, and modernization of a sewage treatment plant and a water treatment facility co-financed using Cohesion Fund and EEA Grant funding totaling over 60 million PLN
2010 - Provided counsel on obtaining a concession for operating an exhibition and display facility under the Construction Work and Service Concession Act, in addition to preparing necessary procedural documentation
2010 - Provided legal services to a cultural institution over the course of its implementation of infrastructure investment under the 2007-2013 Masovian Voivodeship Regional Operational Programme totaling over 91 million PLN, including advising on the award of public procurements
2010 - Represented a leading entrepreneur from the transport & logistics industry in both negotiations and litigation with a bank over foreign exchange option transactions
2009 - Provided legal services to an international consortium applying for a public procurement totaling over 500 million PLN for the construction of a soccer stadium for EURO 2012
2009 - Wrote an expert legal opinion commissioned by the Ministry of Regional Development on ways to make it possible to refund expenditures borne by a lessor in projects implemented under the 2007-2013 Innovative Economy Programme, for which the Ministry of Regional Development is a Managing Unit
