RULES REGULATING USE OF THE INTERNET SITE

I. GENERAL REGULATIONS

Krawczyk & Partners LP with its seat in Warsaw establishes the Rules Regulating Use of pages on the internet site available on the Internet at the address www.krawczyk-legal.com.

Users are required to comply with these Rules as of the moment of downloading of the pages of the internet site described in section 1 above.

By making use of the pages on the internet site www.krawczyk-legal.com, users confirm that they have read the Rules and accept all the regulations therein and undertake to abide by those Rules.
II. DEFINITIONS
For the purpose of these Rules the terms given in capital letters below shall have the following meanings:

KiW - Krawczyk & Partners Limited Partnership with its seat in Warsaw (postcode 00-609) at Al. Armii Ludowej 26, entered into the register of business entities maintained by the District Court for the Capital City of Warsaw, XII Commercial Division of the National Court Register, under number KRS 0000214057, tax identification number [NIP] 525-2284146, REGON statistical number: 015606580.

The Site – means the website or internet pages at the address www.krawczyk-legal.com, containing information purely of an informative and educational nature, designed to enable Users to make use, free of charge, of the information drawn up or published by KiW or commissioned by KiW.

The Rules – means these rules.

The Act - means the Act on Supply of Services by Electronic Means (Journal of Laws no. 144, item 1204, as amended).

A User – means any person using the Site in any whatsoever form.
III. SCOPE OF LIABILITY

Except where KiW has stated otherwise on this Site, the services and products presented on the Site do not constitute an offer as defined in art. 66 of the Civil Code (Journal of Laws of 1964, no. 16, item 93 as amended), and the information regarding the features and specifications of services and products has been provided for informative and education purposes only.

KiW shall not be liable, and shall not accept in particular any civil, criminal, or administrative liability for use by Users of the Site in a manner contrary to the Rules, in breach of the law or third-party rights.

KiW is not responsible for ensuring that the Site is used without errors, defects, or breaks, or for the level of usefulness of information found on the Site.

KiW shall not be liable for any whatsoever losses, whether actual (damnum emergens) or lost profits (lucrum cessans), suffered by Users due to temporary unavailability of the Site, caused in particular due to: force majeure events, errors or breakdowns, including failure of internet connections provided by internet providers, or breakdown of devices or software.

KiW reserves the right to decide, exclusively and independently, the content of the Site, and to make changes or modifications, without prior notification of Users of those changes or modifications, or the nature of them.

Despite taking the utmost care to ensure that the material placed on the Site is complete, true, and up to date, neither KiW nor the authors of material placed on the Site shall be liable towards Users for any whatsoever consequences of use by Users of information obtained via the Site and do not guarantee that it is accurate or up to date. The information placed on the Site does not constitute legal advice or a legal opinion.

In cases in which KiW allows any material whatsoever to be placed on or transferred to the Site, Users shall bear sole liability for the placing or transfer of material to the Site. In such a case the User guarantees that the material and information that it places or transfers to the Site is complete, is not misleading, has been placed or transferred in good faith, that he/she has the right to place and transfer that material, and that neither the placing nor the transfer shall result in breach of law or third-party rights.
IV. INTELLECTUAL PROPERTY RIGHTS

KiW presents or makes available on the Site material which is subject to copyright and intellectual property rights, in particular: trademarks and works, for example texts, publications, articles, graphics, and the layout and selection of content of the Site are protected in their own right under Polish law, in particular under the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2006, no. 90, item 631 as amended), the Act of 21 July 2001 on Database Protection (Journal of Laws of 2001, no. 128, item 1402 as amended) and the Act of 30 June 2000 on Intellectual Property (Journal of Laws of 2003, no. 119, item 1117, as amended).

Under art. 1 above the contents of the Site are protected by law and may not be published, in whole or in part, or be reproduced, without the written consent of KiW.

Users are entitled to make use of the content of the Site (for instance in the form of copying or printing) solely for personal use as permitted by law.

In particular, no material on the Site may be copied, published, projected, transferred, or disseminated in any manner whatsoever without the prior written consent of the entitled entity, except in cases in which use is permitted and in compliance with all notes and information required by law regarding reserved copyright and source material. Modification or use of material for any other purpose whatsoever shall constitute an infringement of economic copyright or related rights vested in KiW or other entitled entities.

In the case described in point III section 7 of the Rules, by making available their own texts on the Site, Users give consent to personal use by other Users as permitted by law, and KiW grants the right to edit, copy, and disseminate that material.

Any trademarks, logos, or trade names whatsoever, whether or not registered, are the property or KiW or other entitled entities where indicated as such. The dissemination or use of these, including recording or use in any other form, without the prior written consent of the entitled entity, is not permitted.

Any commercial or public use of the material described in section 1 above, except within the scope of permitted use as described above, without the consent of KiW, is not permitted.
V. PERSONAL DATA

KiW fully respects the right to privacy and protection of personal data of Users. Detailed rules and conditions for protection of privacy and personal data may be regulated in a separate document entitled “Privacy Policy".

In cases in which Users place personal data on the Site, KiW shall process this data in accordance with personal data protection regulations, including the Act of 29 August 1997 on Personal Data Protection (Journal of Laws of 2002, no. 101, item 926, as amended).

In the cases described in section 2 above, the administrator of the data of the Users, which is processed within the Site, is KiW. Data is provided on a voluntary basis. Users have the right to gain access to and make changes to their data.

KiW gives notice that it may make use of cookies which make it possible to identify Users’ computers due to short texts being saved on Users' computers.
VI. FINAL PROVISIONS

These Rules come into force as of the day they are published on the Site.

KiW reserves the right to make changes to these Rules at any time. Any changes to the Rules will be available on the KiW website www.krawczyk-legal.com. Use of the Site by Users following changes to the Rules constitutes acceptance of those changes. Any changes to the Rules come into force as of the day they are published on the Site.

Any matters not regulated in these Rules shall be subject to Polish law.

In cases in which KiW starts to provide services by electronic means as defined in the Act, these Rules shall be supplemented by the rules for provision of services by electronic means as required under the Act.
